Who is this course for and what is it all about?

If you have an email account, a Facebook account, use the Internet (whether on your phone or laptop, whether at home or in the office or even a cyber café) in India, then you NEED this course. This course will teach you “practically” everything you need to know about the Indian cyber law.

 

Did you know?

• Two Air India cabin crew members were arrested and jailed for 12 days for posting “derogatory” remarks against the Prime Minister’s Office, the national flag and the Supreme Court, while commenting on a strike by Air India pilots. (India, May 2012).

• Ahmad Shuman was arrested for creating a Facebook page criticizing Lebanese President Michel Sleiman. (Beirut, July 2010).

• Two Americans (Vanessa Palm and Alexander Rust) holidaying in the Bahamas, were arrested after posting pictures of themselves eating iguanas. Iguanas are protected under the Convention on International Trade in Endangered Species of Wild Fauna and Flora. (Bahamas)

• Farah Nur Arafah, an 18YyearYold was given a 75Yday suspended jail sentence for calling her friend a “promiscuous, overweight pig” on facebook. (Indonesia, February 2010)

• A student was fined under Canadian underage drinking laws when he posted photos of himself, holding a beer, on facebook. (Canada, November 2009)

• Vikas Mavhudzi was arrested for "subverting a constitutional government" when he posted a facebook message in support of the protests in Egypt. (Zimbabwe, April 2011)

• Ambikesh Mahapatra, a Chemistry professor at Jadavpur University, was arrested for forwarding a cartoon featuring the West Bengal CM Mamata Banerjee. (April 2012, India)

• Ravi, a small scale industrialist in Puducherry was arrested for tweeting that "Karti Chidambaram (Union Finance Minister P Chidambaram's son) had amassed wealth more than that of Robert Vadra, sonYinYlaw of Congress President Sonia Gandhi". (October 2012, India)

 

Facebook Law in India

  •  Is it legal to ridicule a Government official or Minister on Facebook?

Porn Law in India

  •  Is it legal to watch pornography on the Internet?

  •  Is it legal to sell pornographic movies on DVD?

  •  Is it legal to email a link of a porn movie, to a friend?

Rohas Nagpal

Rohas Nagpal is a lawyer by qualification, a cyber crime investigator by profession, a hacker at heart and a programmer by passion.

He advises corporates, law firms, Governments and law enforcement agencies on issues relating to technology law, cyber crime investigation, information warfare and cyber terrorism. He has assisted the Government of India in drafting rules and regulations under the Information Technology Act. He is an active public speaker on technology issues and has addressed thousands of students, law enforcement personnel, lawyers and other professionals around the world.

Rohas conducts training programs in technology law and cyber crime investigation and has authored several books, papers and articles on these topics.

He has authored several books in digital forensic investigation, technology law and financial law. One of his

publications, the Cyber Crime Investigation Manual, has been referred to as a “bible for cyber crime investigators” by Times of India – the world’s largest selling English newspaper. He is also the author of the first ever Commentary on the Information Technology Act.

Papers authored by him include Internet Time Theft the Indian Law (Bangalore, 2001), Legislative

Approach to Digital Signatures (Ecuador, 2001), Indian Legal position on Cyber Terrorism, Encryption and preventive measures (on behalf of the Karnataka Police for Otto Schily, Interior Minister, Federal Republic of Germany), Defining Cyber Terrorism (Nagpur, 2002), The mathematics of terror (Nagpur, 2002) and Cyber Terrorism – A Global Perspective (Spain, 2002).

He has also co -authored an Internet Draft titled Biometric based Digital Signature scheme, which proposes a method of using biometrics to generate keys for use in digital signature creation and verification.

He was part of the team that developed the world’s smallest cyber crime investigation device, pCHIP a Portable Mega Investigation Forensic Solution. This device is capable of capturing volatile evidence from a live computer, has an easy to use interface, and provides detailed reports.

He is the founder of Cyber Attack, an open community working for cyber security. He also maintains a specialized search engine that tracks bugs and vulnerabilities in Microsoft® products. He isalso the founder of the proud Indian.me project and the Woman 2.0 Foundation.

He is a member of Information Systems Audit and Control Association (ISACA), International Association for Cryptologic Research (IACR), and a Sustaining Member of the Internet Society (ISOC), which is the organizational home of the Internet Engineering Task Force (IETF), the Internet Architecture Board (IAB), the Internet Engineering Steering Group (IESG), and the Internet Research Task Force (IRTF) the standards setting and research arms of the Internet community.

In 1999, Rohas Nagpal co-founded Cyber Tribe which today is comprised of 10 organizations Y Asian School of Cyber Laws, TechJuris Law Consultants, ASCL Law School, Data64 Techno Solutions Pvt.  Cone of  Learning

At ASCL, we have integrated the principles of the cone of learning (proposed by Edgar Dale) into our teaching methods.

Student are said to retain 10% of all that they read. This retention is helped by our excellent courseware - written in a simple language and embedded with real world illustrations.

At the second level of retention, ASCL courses have contact classes built into the teaching structure.

The students listen to the teachers' lectures in which important issues are constantly highlighted by way of repetition and emphasis.

Contact classes rely heavily on multimedia presentations so that students can also retain information at the third level. This advantage is also passed on to digital mode students through clearly laid out images and diagrams embedded in the course ware.

Students remember 50% of what they see and hear simultaneously. We bring in this aspect of learning by way of demonstrations.

Our teachers explore various issues through live practical demonstrations and video clippings.

Even so, according to the cone of learning, these methods or learning are only the passive methods.

At ASCL, we have taken steps to involve our students more active retention methods.

Some of our achievements

ASCL Computer Crime & Abuse Report (India) is the only study of its kind quoted

by the United Nations in its E-commerce & Development Report (2003).

This third edition of the E-Commerce and Development Report, published by the United Nations Conference on Trade and Development, identifies some of the implications that the growth of the digital economy may have for developing countries.

 

Relevant extract from the report:

Studies based on reported security incidents assess internal threats as being as severe as external ones.

For example, the Asian School of Cyber Laws study Computer Crime and Abuse Report 2001–02 for India showed that over half of the reported incidents were traced to employees (21 per cent) or former employees (31 per cent).

In the end, the question of IT security at the firm level is much more a managerial problem than a technical one.

It has to do with how penetrable the enterprise wants its business processes to be and how risk management is integrated into those processes.

Management must decide what balance to strike between the benefits of open, collaborative business processes and the risks that greater exposure entails.

 

Federal Republic of Germany

We were invited to make a presentation on "Indian Legal Position on Cyber Terrorism, Encryption and Preventive Measures", on behalf of the Karnataka Police, for Otto Schily, Interior Minister, Federal Republic of Germany.

Bangalore may have taken the tag of India's Silicon Valley and Hyderabad would have rechristened itself as cyberabad, but when it comes to fixing the cyber crimes, Pune seems to have taken the lead over its illustrious peers.
